Former NDA practice head steps down, goes independent | India


Vyapak Desai, former head of international disputes, has quit Nishith Desai & Associates after 20 years to establish Vyapak Desai Law Chambers in New Delhi.

Speaking to India Business Law Journal, Desai said, “The decision was driven by two reasons: one, the longstanding need to set up my own independent chamber practice and be at the forefront of dispute resolution before both courts and arbitral tribunals.

“And two, the time was right to pass the baton to the next generation at Nishith Desai & Associates, a firm which I admire and will be grateful to for the vision and opportunities it provided me in the last two decades of my professional career.”

Desai’s two-decade career began as an advocate at Singhi & Co, where he later led the practice. He joined NDA as a part of the capital markets practice in 2005, where he remained until July this year. He established and spearheaded the firm’s international disputes and investigations practice, which included white-collar crime.

Desai said his legal practice would fill a void in the current legal landscape. “In India, a lot is lost between the business expectations in a boardroom and legal interpretations in a courtroom,” he said.

“The long-term vision is to establish an independent chamber comprising high-quality senior legal counsels combining both written and oral advocacy. Focus areas for practice will be transnational litigations, BIT [bilateral investment treaty] and international commercial arbitrations [and] white-collar crime in various industries such as financial services, TMT, infrastructure, etc.”

Desai said that after his long and fulfilling stint at NDA, he felt overwhelmed with the support and positive responses received from clients in the legal industry.

“This gives me a sense of confidence for future work and satisfaction about the work I have done in the past 25 years as a practising advocate,” he said.

Currently, the former NDA partner continues as co-chair of the Council at the Mumbai Centre for International Arbitration, since it was founded, serves as the vice president of the Arbitration Bar of India, director of the Chartered Institute of Arbitrators, India, co-chair of the Society of Construction Law India, Mumbai Chapter and convenor of the Indian Arbitrator Forum.

He is also a registered foreign lawyer with the Singapore International Commercial Court, Dubai International Financial Centre, and listed as an arbitrator on panels of various institutions such as the International Centre for Dispute Resolution, Singapore International Arbitration Centre, London Court of International Arbitration and the Securities and Exchange Board of India.
